Terms & Conditions of Booking

PLEASE READ THESE CONDITIONS CAREFULLY, WHEN YOU MAKE A RESERVATION YOU ARE ENTERING INTO A LEGALLY BINDING CONTRACT THE TERMS OF WHICH ARE SET OUT IN THESE CONDITIONS.

 

BOOKING Peterstone Lodge

The contract for a short-term holiday rental will be between ourselves the legal owners of Peterstone Lodge (referred to as “us” or “we” ) and the person making the booking and all members of the holiday party (referred to as “you” or “your”) in the following booking conditions, the law of England and Wales will govern the Contract. The contract of hire is not effective until we have received the relevant deposits and payments and sent confirmation. The person making the booking must be 18 or over.

 

Duration and Times of Lettings

You should not arrive before 4pm on the commencement date, and leave by 10am on the day of departure. Failure to do so will result in you being charged a further day’s rental. ou must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tennant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.

 

Booking Procedure

We reserve the right to decline bookings at our discretion.All applications to book holidays in the properties must be submitted by you to us using our standard booking form or online enquiry form. The Booking Form must be fully completed by you and must be accompanied by the relevant payment or booking fee.

 

Acceptance of an Application

The contract between us and you for the letting of the property shall arise upon us giving written confirmation of acceptance of your application (which at our discretion may be dispatched by pre-paid post or electronically to any email address provided by you in the booking form) or upon us having obtained clear funds in respect of the application fee whichever is the later.

 

Booking / Payment Method

If reservations are made more than six weeks before the holiday start date, a deposit of one third of the total rental cost is payable. The outstanding balance should be paid six weeks before the holiday start date (no reminder is sent).

Alternatively, if the booking is made less than six weeks before the holiday start date, the entire holiday cost should be paid to Peterstone Lodge.

Payment is by cheque, cash or bank transfer. Please contact the owner to arrange

Note if booked directly with the owner VAT is not currently payable however this may change and if booked through any other website or third party VAT may be applicable. we will notify you immediately.

 

Security/Breakages Deposit

A security/breakages deposit is required to be held at the time of final payment (to be paid by cheque, cash or bank transfer ). Of £250 .All or part of the security deposit will be retained if Peterstone lodge is not left in the clean and tidy condition in which it was found, to cover the cost of any additional cleaning and laundry required over the usual designated amount, removal of excess rubbish any damage to the property content or the replacement of bedlinen or towels, or the homeowner’s insurance excess if a repair or replacement exceeds the specified deposit amount.

 

Cancellation

The Hirer is advised to arrange holiday insurance to give protection in the event that the Hirer is unable, for any reason, to take up the holiday accommodation at the agreed time. The Hirer should notify us of any cancellation immediately. For any cancellation before or after the arrival date, not only will the booking fee and deposit be forfeited but also the balance of the holiday will be payable by the Hirer. If the property can be re-let then an appropriate refund will be made, but the booking fee and deposit are always non-refundable.

 

Booking Alteration

Rarely, for reasons beyond our control. we have to cancel or alter arrangements made for the Hirer – in this event we will contact you as soon as possible and offer a full refund of monies paid to date.

 

Complaints Procedure

In the unlikely event of a problem, all complaints must be received in writing before the end of the holiday rental to enable any issues to be resolved. Please note that no correspondence can be entered into concerning complaints made upon departure or after your return home.

 

Liability

The home owner accepts no responsibility for any damage or injury caused by use of the accommodation and any amenities and such use is at the Hirer’s own risk. The details and prices in the brochure/website may be subject to change. The information given in the brochure and on our web site is believed to be correct and true at the time of going to press. The Owner cannot be held responsible for (and cannot accept liability for) issues outside their reasonable control such as breakdown of domestic appliances, plumbing, electrical problems, structural repairs, non-working Wi-fi, poor TV reception, invasion of pests, infestations or damage caused by exceptional weather conditions, or by noise and disturbance resulting from nearby building works, noisy neighbours or local events.

 

Occupancy

It is not permitted to exceed the maximum occupancy (stated in brochure & web site) unless prior agreement is given as this can invalidate our property insurance. You must not hold events, such as parties’ celebrations or meetings at the property without the prior consent of the owners. You should advise us of the party size at point of booking and any changes prior to arrival Over occupancy is considered to be a serious infringement of the Terms and Conditions and can result in an immediate requirement to vacate the premises, with no refund of monies due, and possible further charges in the event of damage to the facilities caused by excess usage (for example, a malfunctioning septic tank which has been used by a greater number of people than the tank is designed for).

 

Changes to bookings

We will consider any request to change dates after confirmation has been issued however not 4 week before taking up the holiday. We reserve the right to charge an administration fee of £25 in the event a change of booking is made.

 

Wood Burner

To maintain the efficient operation of the wood burner and flue pipe, please only use the seasoned wood provided by us on your arrival any additional wood must be purchased, do not burn any other materials. Never leave the fire unattended. The use of candles inside or outside Peterstone Lodge is strictly prohibited. Turn off all electrical appliances before going to bed and close all doors.

 

Dogs

We will allow one or two well-behaved dogs/pets to stay, A minimum additional charge of £35 per dog/pet short stay or per week is made to cover any extra cleaning costs.

Dogs/pets are not permitted on beds or furniture, or in any shared facilities. You must not leave any pets unattended in the property, including the garden. Registered assistance dogs may be allowed in properties where the description says that pets are not allowed, but only with the express permission of the owner of the property.

If you or any member of your party has a pet allergy, we can not accept any responsibility for any subsequent health reaction. It is your responsibility to make specific enquiries. Please remove any evidence left by your dog/pet in the property and grounds.

To make the garden dog safe, the perimeter has a 1 metre high chicken wire rabbit fence has been placed around the base of the mixed dense hedging.

 

Bed Linen and Towels

Bed linen and towels must remain inside the property and should not be used as beach towels. If you are staying in a property for 2 weeks or more, bed linen and towels can be changed weekly on request.

 

Noise on the Property

We request noise to be kept to a minimum between the hours of 11pm and 7am. On warm evenings, music must not be played outside past 10pm and kept to a reasonable level inside.

 

Damages and Damage Deposit

Smoking is not allowed in any part of the property.

 

Outside Equipment BBQ

You agree that the use of the outside BBQ equipment is at your risk in all respects.

 

Guest Registration

You confirm that you are authorised to sign the booking form on behalf of all persons who will occupy the property and that those persons are aware of the booking conditions. You shall be a member of the party occupying the property and are required to ensure that:

1. Each member of the party on whose behalf you have submitted the Booking Form is listed on the
booking form with his or her full name and age if under 30 . Photographic evidence such as passport or driving licence may be required

2. Each member of the party is aware of and will comply with all rules and regulations published by
ourselves in respect of the use and occupation of the Properties;

 

Force Majeure

In these terms and conditions “Force Majeure” means any circumstances beyond our reasonable
control including, without limitation, an Act of God, Fire, Flood, War or Acts of Terrorism. If by reason of Force Majeure the property is not available at the commencement of the time booked by you or the property is unsuitable for letting at that time, we shall not be deemed to be in breach of contract.but shall refund in full to you all fees, charges and any deposit paid in advance by you. We will not be liable for any other claim for loss or damage by you.

 

General

(a) In the event of any conflict between these booking conditions and any other contents of any
brochure or website, these conditions shall prevail.
(b) These terms and the contract between you and us shall be subject to and interpreted in
accordance with the law of England and Wales and the courts of England and Wales shall have
exclusive jurisdiction to hear any claim arising from such contract.
(c) Words herein denoting the masculine gender shall, where the context so admits be taken to
include the feminine and neuter genders and vice versa.
(d) Words herein denoting the singular shall, where the context so admits be taken to include the
plural and vice versa.

WE REQUIRE THAT OUR GUESTS READ AND SIGN THE FOLLOWING CONDITIONS WHICH SHOULD BE
READ IN CONJUNCTION WITH AND FORM PART OF THE BOOKING CONDITIONS.

1. To behave in such a manner as not to disrupt the enjoyment of other people staying in the near
vicinity or prejudice the reputation of the owner of the property.
2. Your holiday or that of any third party residing or making use of the property during the period of
your reservation in breach of this clause may be terminated immediately and without Compensation
or any further obligation. Any damage to facilities arising out of misuse or as a result of negligence
and/or failure to follow the instructions herein will be chargeable to you.

 

Security and Privacy

The Peterstone Lodge will ensure that:
1. Personal data is only used for the legitimate interests of Peterstone Lodge and
does not unduly prejudice the rights and freedoms of the individual in question.
2. Personal data will be processed fairly and lawfully in accordance with the Data Protection Act.
3. They will not process “sensitive” personal data without prior consent from the member.
4. Access will be granted to computerised personal data in the form of a computerised “printout”, and to manual personal data at its discretion.
5. Information processed is accurate, relevant, current, up to date and not excessive.
6. Personal data will be kept only for so long as is necessary for the specified purposes.
